1. Definitions / Interpretation

“The Company” means Prints & Fine Art Company.

“Goods” means all products and services agreed to be supplied by the Company.

“The Buyer” means the person or Company with whom the Company have entered into a contract for the sale of the Goods or provision of services.

“Website” means the entire computing hardware and software installation that is or supports our Website. 

The below Terms & Conditions are written in English language only. In the case of any conflict in meaning between this English language version of this agreement and any other version, the English language version shall prevail.

2. Contract

2.1. By placing the order on this Website and by purchasing the Good(s), you warrant that you are legally capable of entering into binding contracts and that you are at least 18 years old.

2.2. Prints & Fine Art reserves the right, at any time, to modify, alter, or update these Terms & Conditions, and you agree to be bound by such modifications, alterations, or updates. The terms that apply to you are posted here on this Website on the day you order the Good(s). Thus, we strongly advise you to print a dated copy of this Terms & Conditions for your records.

2.3. If in future, you buy Goods from us under any arrangement which does not involve your payment via this Website, these terms still apply so far as they can be applied.

3. Order and Acceptance

3.1. Your order is an offer to buy from us and as such must be accepted by us to become contractually binding. After placing an order, you will receive an e-mail from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted.

3.2. We will confirm an acceptance of your offer by sending you an e-mail confirming that the Good(s) have been dispatched. The contract between us is formed upon us sending you the Product Dispatch Confirmation.

3.3. At any time before the Good(s) are dispatched, we may decline to supply the Good(s) to you without giving any reason.

3.4. We operate a real time stock order system. All images displayed on our site are in stock. If an item is not in stock the words “Currently Unavailable” will be displayed.

4. Price and Payments

4.1. All prices quoted on the Website include Value Added Tax (VAT).

4.2. Prices and delivery charges are subject to periodical changes. However, those changes will have no impact on orders for which we have already sent a Product Dispatch Confirmation.

4.3. Payment for all Goods must be submitted by one of the following methods available on our Website:

6. Non Delivery and Damages:

NON-DELIVERY to be advised in writing to customercare@printsandfineart.com within 14 days from date of goods being despatched to a mainland UK delivery address & 21 days from date of goods being despatched to a delivery address outside of the UK.

DAMAGES OR SHORTAGES to be advised in writing to customercare@printsandfineart.com within 3 days of delivery.

GOODS RETURNED TO PRINTS AND FINE ART BEYOND OUR CONTROL. All goods are shipped with a reputable courier (e.g. UPS, FedEx etc.,) so that each order can easily be traced from time of despatch through to point of delivery.  The couriers will make multiple attempts to deliver your order. If after these attempts have been exhausted, the goods may be returned to Prints and Fine Art by the courier. If it is deemed the return of goods was not at fault of Prints and Fine Art and / or courier, it may be necessary to charge the client for the cost of shipping the goods being returned to Prints and Fine Art. This charge is £15.00 per package originating within Mainland UK, being returned to Prints and Fine Art . Costs for overseas returns are calculated on a case by case basis, and any import duties and taxes will need to be paid by the client of Prints and Fine Art.  

Orders that have been returned to Prints and Fine Art through no fault of Prints and Fine Art and / or the courier, can be resent once the client has paid for the both the return costs and the cost of re-shipping to their chosen destination.

7. Limitation of Liability

Prints & Fine Art shall not be liable for any consequential loss, expense or damage arising directly or indirectly from any defect or failure in the Goods or from their use of damage. We shall not be liable for any losses incurred in the delay or non-delivery of your image.

You agree that the design, trademarks, logos and intellectual rights to all parts of this Website belong to Prints & Fine Art and must not be used without our express permission. All persons, individual and corporate are prohibited from providing hypertext and other links to the Prints & Fine Art website, other than to our home page, from their own website or from a third party site without prior written consent.

By providing your details on our Website you consent to Prints & Fine Art maintaining, holding and using the information given. All data is stored in accordance with the Data Protection Act 1998. If you purchase with us you agree to be bound by these terms and conditions. The conditions shall be incorporated in every contract for the sale or supply of Goods by Prints & Fine Art Company and together with the relevant order and invoice constitute the entire contract between the Company and the Buyer. Any conditions proposed by the Buyer whether endorsed on the order form or otherwise which are inconsistent with these terms and conditions of trade are hereby excluded. In any event the maximum liability to the vendor is the value of the invoice covering the goods.

Delivered Goods shall be held by the Buyer as the Company’s bailee until all monies due from the Buyer to the Company in relation to such Goods have been paid and any Goods delivered but not paid for shall be separately stored so as to be readily identifiable by the Company. Until such payment in full is made the Company shall retain full legal and equitable title to the Goods and the Company shall be entitled to enter on any premises of the Buyer for the purpose of removing the Goods.

The copyright in and all other rights in Goods supplied to the Buyer by the Company shall be and remain vested in the Company or in the copyright owner shown on the Goods. The Buyer shall not mount, frame or otherwise package any of the Goods in any way which might indicate to a purchaser that the Buyer is the owner of any copyright in the Goods or alter or market the Goods in any manner which might infringe the copyright or any other intellectual property rights of the copyright owner or of any third party.

If any claim shall be made against the Buyer that any Goods supplied infringe the copyright or any other right of any third party the Buyer shall promptly notify the Company thereof and the Company shall be entitled to conduct all negotiations for the defence of settlement of any such claim. The Buyer shall afford all reasonable assistance to the Company in contesting any such claim and shall not make any admissions which may be prejudicial to the defence thereof.

Except as may be otherwise required by the law the Company will accept no liability to the Buyer or its customers under any so called ‘product liability laws’ in force in any part of the world nor shall the Company be liable to the Buyer or to anyone else for any incidental or consequential damages or any loss of business or property.

All contracts between the Company and the Buyer shall be governed by the laws of England and any dispute arising thereunder shall be subject to the sole jurisdiction of the English Courts.

We reserve the right to vary these conditions from time to time.
